A legal battle between Elon Musk and OpenAI CEO Sam Altman has gone to trial in Oakland, California, marking a major escalation in a dispute over the company’s structure, mission, and control.
Musk, a co-founder of OpenAI, is suing Altman, OpenAI, and Microsoft, alleging the organisation abandoned its original nonprofit mission to develop artificial intelligence for public benefit after shifting toward a for-profit model.
According to court filings, Musk argues he was misled about the company’s long-term direction and claims the restructuring violated its founding principles.
Musk alleges he was “duped when Altman transformed OpenAI from a non-profit entity into a for-profit juggernaut.”
OpenAI has denied wrongdoing, arguing that Musk’s claims are driven by competitive interests after he left the organisation and later founded rival AI company xAI.
OpenAI contends Musk is “motivated by jealousy” and disputes that any agreement permanently blocked a shift toward a for-profit structure.
The trial is expected to include testimony from Musk, Altman, and Microsoft CEO Satya Nadella, and may run for several weeks.
Musk is seeking more than $100 billion in damages and has also asked the court to reverse OpenAI’s restructuring and remove its current leadership, according to filings and court summaries.
